1. Acceptance of Terms

By accessing, downloading, or using FreeGuard VPN (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.

If you are under 18 years of age, you must have your parent or legal guardian’s permission to use the Service. By using the Service, you represent that you have such permission or that you are 18 years or older.

Planetlink INC (“we”, “us”, “our”) reserves the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Service Description

FreeGuard VPN provides virtual private network (VPN) services to enhance your online privacy and security. Depending on your platform, we offer the following types of service:

2.1 Free Service

  • Available only on platforms where ad-supported access is offered
  • Access to limited VPN nodes through ad-supported usage
  • Users must watch advertisements to earn access time
  • Subject to additional usage restrictions and limitations
  • Not available in the Apple TV/tvOS app

2.2 Premium Subscription Service

  • Full access to all VPN nodes and features
  • No advertisements
  • Payment accepted through Apple Pay, Google Pay, cryptocurrency, and Stripe-supported payment methods
  • Billed on a recurring subscription basis

The Apple TV/tvOS app is a premium subscription-only product. After subscription entitlement is confirmed, the Apple TV app displays VIP VPN nodes only.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or free from interruptions.

3. Account Registration and Management

3.1 Account Creation

To use the Service, you must create an account by providing a valid email address and other required information. You agree to provide accurate, current, and complete information during registration.

3.2 Account Uniqueness

Each user is permitted to create only ONE free account. We use technical measures including but not limited to email addresses, device identifiers, payment information, and other metadata to identify and prevent duplicate account creation.

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

3.4 Account Sharing Prohibition

You may not share, transfer, sell, or otherwise provide access to your account to any third party. Accounts found to be shared may be immediately terminated.

3.5 Prohibited Re-registration

Users whose accounts have been terminated for violations may not create new accounts. Any attempt to circumvent this restriction will result in immediate termination of all associated accounts and permanent ban from the Service.

4. Acceptable Use Policy

Your use of the Service is subject to this Acceptable Use Policy. Violation of any provision in this section may result in immediate suspension or termination of your account without refund.

4.1 Absolutely Prohibited Activities

You must not use the Service for:

  • Child sexual abuse material (CSAM) or any content exploiting minors
  • Human trafficking or modern slavery
  • Terrorism-related activities or communications
  • Any activity that constitutes a serious crime under international law

4.2 Network Abuse Strictly Prohibited

You must not use the Service to:

  • Send spam, unsolicited emails, or phishing messages
  • Launch, participate in, or facilitate Distributed Denial of Service (DDoS) attacks
  • Conduct network intrusions, hacking attempts, or unauthorized access to systems
  • Perform port scanning, vulnerability probing, or network reconnaissance
  • Distribute malware, viruses, trojans, or other malicious software
  • Use BitTorrent, peer-to-peer (P2P) file sharing, or any form of torrent downloading

4.3 Illegal Content and Activities

You must not use the Service to:

  • Transmit copyrighted material without authorization
  • Infringe on trademarks, patents, trade secrets, or other intellectual property rights
  • Engage in defamation, harassment, threats, or stalking
  • Conduct any activity that violates laws in your jurisdiction or the jurisdiction where our servers are located
  • Engage in fraud, identity theft, or financial crimes

4.4 Free Service Specific Restrictions

This section applies only to platforms where we offer a free ad-supported service. It does not apply to the Apple TV/tvOS app, which is subscription-only.

If you are using the free ad-supported service, you must not:

  • Circumvent, block, or interfere with advertisement delivery mechanisms
  • Use automation tools, bots, or scripts to abuse the free service
  • Exceed reasonable usage limits as determined by us

We reserve the right to determine what constitutes abuse based on traffic patterns, connection behavior, and other technical indicators.

5. Monitoring and Detection Rights

5.1 Abuse Detection

We employ automated systems to monitor for abnormal traffic patterns, suspicious connection behavior, and potential abuse of the Service. While we do not guarantee real-time monitoring of all activities, we reserve the right to:

  • Analyze network traffic metadata to identify potential violations
  • Investigate accounts suspected of abuse
  • Use machine learning and behavioral analysis to detect anomalies

5.2 Anonymous Log Retention

To prevent abuse and maintain service quality, we retain only anonymous, non-identifiable logs. These logs:

  • Do NOT contain your real IP address
  • Do NOT contain your browsing history or DNS queries
  • Do NOT contain the content of your VPN traffic
  • Cannot be used to identify individual users or their online activities

What we collect (anonymously):

  • Aggregated connection statistics (for capacity planning)
  • Anonymized bandwidth usage data
  • Payment and subscription records (for billing purposes only)
  • Account authentication events (email and login timestamps)

We employ technical measures to ensure logs cannot be traced back to specific users or their activities. Your privacy is protected by design.

5.3 Technical Enforcement

We use technical measures including device fingerprinting, email verification, payment information validation, and IP address analysis to enforce these Terms and prevent abuse.

6. Service Termination and Suspension

6.1 Termination by Company

We reserve the right to immediately suspend or terminate your account and access to the Service, with or without notice, if:

  • You violate any provision of these Terms
  • We detect abuse or suspicious activity associated with your account
  • We are required to do so by law or legal process
  • Continued provision of service to you poses risk to our infrastructure or other users

Users permanently banned for violations are prohibited from creating new accounts. We will use technical means including but not limited to email addresses, device identifiers, and payment information to identify and prevent re-registration attempts.

6.2 No Refund for Violations

Accounts terminated for violations of these Terms are not entitled to any refund, including for unused subscription time. All payments are final and non-refundable in cases of termination for cause.

6.3 User-Initiated Termination

You may stop using the Service at any time. Premium subscribers may cancel their subscription through their payment provider (Apple App Store, Google Play Store, or Stripe), but already-paid subscription fees are non-refundable.

7. Law Enforcement Cooperation

We are committed to preventing illegal activities and cooperating with law enforcement authorities.

We will comply with valid legal requests from law enforcement agencies, including subpoenas, court orders, and other lawful demands for information.

7.2 Information Disclosure

In response to valid legal process, we may disclose:

  • Account registration information
  • Connection logs and activity records
  • Payment and subscription information
  • Any other data required by applicable law

7.3 Proactive Reporting

We may proactively report suspected illegal activities to appropriate authorities, particularly in cases involving child exploitation, terrorism, or other serious crimes.

8. Intellectual Property

The Service, including the FreeGuard VPN application, website, and all associated trademarks, copyrights, database rights, and other intellectual property rights, belong to Planetlink INC.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes in accordance with these Terms. You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the application or any component
  • Remove or alter any proprietary notices or labels
  • Use our trademarks without prior written permission
  • Attempt to extract source code or underlying algorithms

9. Disclaimers and Limitation of Liability

9.1 Service “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee of Service

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service will meet your specific requirements
  • Any particular VPN server will be available at any given time

9.3 Internet Connection Responsibility

Certain functions of the Service require an active internet connection (Wi-Fi or mobile data). We cannot be held responsible for the Service not functioning at full capacity if you do not have access to internet connectivity. Any data charges from your mobile network provider are your responsibility.

9.4 Device Responsibility

You are responsible for ensuring your device remains charged and functional. We are not responsible if you cannot access the Service due to device battery depletion or other device-related issues.

9.5 VPN Is Not Immunity

Using a VPN does not grant immunity from legal responsibility. You remain fully accountable for your actions while using the Service. A VPN is a privacy tool, not a license to engage in illegal activities.

9.6 Third-Party Services

We rely on third-party infrastructure providers and services. We are not responsible for failures, interruptions, or issues caused by third parties beyond our reasonable control.

Third-party services vary by platform and feature set. The app and service may use third-party services that declare their own terms, privacy policies, or data processing practices, including:

  • Apple App Store and in-app purchase systems for subscription purchase, renewal, cancellation, and entitlement status on Apple platforms.
  • Firebase Core and Firebase Crashlytics for app diagnostics, crash reporting, and performance troubleshooting.
  • Google Play Services and Google Play billing systems on Android platforms where applicable.
  • Advertising, analytics, and mediation services on platforms where free or ad-supported access is offered, as disclosed in the privacy policy for that platform.

The Apple TV/tvOS app does not include advertising SDKs and is governed by the separate Apple TV Privacy Policy.

9.7 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANETLINK INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Service Changes and Updates

10.1 Application Updates

We may release updates to the FreeGuard VPN application to add features, fix bugs, or improve performance. While we strive to maintain backward compatibility, system requirements may change. You may need to update your application to continue using the Service.

We do not guarantee that the application will always be compatible with your specific device or operating system version. You agree to accept updates when offered.

10.2 Service Modifications

We reserve the right to:

  • Add, modify, or remove features from the Service
  • Change server locations or availability
  • Adjust subscription pricing for new subscribers
  • Discontinue the Service entirely

We will make reasonable efforts to notify users of significant changes, but we are not obligated to provide advance notice.

11. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our practices, legal requirements, or Service features.

When we make changes:

  • The “Last Updated” date at the top of this document will be revised
  • We will post the new Terms on this page
  • For material changes, we may provide additional notice through the application or via email

Your continued use of the Service after Terms changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
